Kroger Pays Out $2.3 Million in Slip and Fall Lawsuit

A man from Douglasville, Georgia, has won a $2.3 million lawsuit against the Kroger Co. grocery chain. The plaintiff had slipped on crushed fruit in the deli area of a Kroger store and fell onto his back. As a result, his lawyer said that the man suffered a spinal injury, requiring multiple surgeries totaling $135,000 and losing his ability to work.

What especially got Kroger into hot water was their apparent destruction of crucial video evidence of the slip in question. Kroger lawyers claimed that tapes are only saved for 17 days and the tapes from that day had been erased. They also provided sample images to prove that the camera did not even point in the direction of the fall.

However, a demonstration of the cameras proved that the camera was actually centered on the spot where the fall took place. The judge found that Kroger had destroyed the critical video evidence, and a jury came back with the $2.3 million verdict.

The company behind the now unpopular Power Balance wristbands is allegedly being forced to pay the high sum of $57 million dollars to a large number of very upset consumers.

Several news outlets have stated the news regarded as a great victory for various classes of consumers all over the globe.

The athletic bracelets could never truly prove the many things the company promised those who purchased this item. Because the idea of enhancing the body’s natural energy couldn’t be backed up by any scientific source, the claims of dubious hopes were allegedly perpetuated among the public and the grand jury.

The lawsuit filed against the company back in January forced the bracelet maker to offer a public statement announcing the bracelets had no proven capacities to deliver what the manufacturers promised.

News agencies have reported that $1 million dollars had to be given to some of the consumers filing the lawsuit back in September.

Massive Fraud Lawsuit Forces Power Balance To File for Bakruptcy

According to various news sources, Power Balance wristbands, which were sold to millions of consumers worldwide, are not what they claim to be.

A recent lawsuit filed against the manufacturer of the rubber bracelets forced the company to pay off $57 million dollars to the customers being represented in this case.

No scientific proof could be collected in the defense of the wristbands. The promises of enhanced strength, flexibility and balance could never be accounted for and consumers never got what they were promised. Personal injury lawyers were of great assistance to the consumers who felt strongly about this issue.

Bankruptcy is in the cards for the one-time sensation Power Balance wristbands, which are due to stop making business for good.

Although the news state the company will not be able to continue to survive, secondary sources allegedly claim that Power Balance will not stop doing business while the manufacturer is seeking some protection under the Chapter 11 of the bankruptcy law.

According to the reports, $1 million had be paid to the consumers by last September.

According to the news TMZ website, the company responsible for the manufacturing and distributing of the once popular Power Balance bracelets might be forced to close shop.

The news source states that Power Balance has to pay an alleged sum of $57 million dollars to the group of people claiming the company to be dishonestly selling the wristband by promising something it doesn’t deliver.

The class action suit was filed back in January of 2011 in federal court in L.A. after consumers felt they were being wrongfully led to believe the hologram-embedded wristband was a scientifically tested device that would enhance strength, balance and flexibility. Although all of these promises were made by the Power Balance brand, none of them were actually backed by tangible scientific evidence.

The settlement has been reached and it’s directed to compensate all consumers misled into purchasing the product basing their decision on the fabricated notion they would benefit physically from the wristband.
